Case Study: Healthcare

A strong advocate rescues a career dedicated to helping others.

A foreign physical therapist working in the United States was seeking to adjust her work visa status to permanent resident status. However, her prior counsel had failed to respond to a Request for Evidence on the green card application and also failed to maintain the therapist’s underlying nonimmigrant work visa status. Due to this negligence, not only was the therapist’s permanent residency application denied, but she and her husband immediately fell out of legal status. Her job and the couple’s future in the United States fell into doubt.

At that point, the therapist contacted Susan Im about her case. Susan worked with the husband’s employer to make a “good cause” argument with the U.S. Citizenship and Immigration Service (USCIS) based on the negligence of prior counsel. This action resolved the immediate out of status issue by securing H-1B status for him and H-4 status for her.

Soon after, the therapist received long-term employment offer, which allowed her to secure H-1B status, as well. Having resolved the couple’s work visa status, Susan then successfully secured their permanent residency. Once faced with the possibility of leaving their careers to return to their country of origin, the couple now continues to live and work in the United States on a permanent basis.
