Making the Case: Immigration Solutions for Manufacturers
One of our clients is a multinational, high-precision manufacturer of plastic and metal components for vehicles. Employing over 1,300 workers, the company utilizes state-of-the-art technology and automation to create cost-effective, quality products. Our client sought green card status for one of its key tool designers and his family members.
ImLaw was able to successfully navigate our client through the PERM labor certification green card process. PERM is the first of three stages in the complex employment-based permanent residency process that many foreign professionals undergo. Employers seeking PERM labor certification must prove through a series of specified recruitment efforts that there are no qualified U.S. workers available and willing to perform the PERM-offered position. Additionally, employers must pay the PERM-offered salary to foreign national beneficiaries at the time their green card application is approved. The PERM-offered salary must meet or exceed prevailing wage requirements as determined by the U.S. Department of Labor (DOL).
Our team walked alongside the client to ensure all PERM requirements were meticulously and timely met. As a result, the client’s PERM application was certified/approved by DOL. Next, ImLaw worked with the company to prepare and file the I-140 immigrant petition with United States Citizenship & Immigration Services (USCIS). After receiving the I-140 approval, ImLaw was able to work with the tool designer and his family members to prepare and file the final stage of the PERM-based green card process known as the I-485 adjustment of status applications. The I-485 applications were approved by USCIS without issue, enabling this key employee to continue providing his essential services to the international corporation on a long-term, permanent basis. We consider this outcome to be a success for the company, the individual, and the broader community.
